1. Scope of Engagement
These Terms of Service govern the remote video editing, audio cleaning, color grading, and subtitle authoring services provided by Olav Bergan operating under the trade identity Nuxnim Post-Production ("the Studio") to individual clients and creators ("the Client").
2. Scoping & Commercial Terms
Initial discovery consultations conducted via telephone, email, or video call (up to 30 minutes) are provided entirely free of charge with zero obligation. Before any video or audio post-production commences, the Studio issues a written project estimate specifying:
- The duration and quantity of raw footage to be processed.
- The deliverables agreed upon (e.g. master 4K video, podcast audio master, subtitle files, short-form clips).
- The fixed total price and delivery schedule.
No work begins without written confirmation of the estimate from the Client. There are no recurring auto-renewing subscriptions or unannounced fees.
3. Client Intellectual Property & Footage Rights
The Client retains 100% full, exclusive ownership and copyright over all raw recordings, voice tracks, and imagery provided to the Studio, as well as the final rendered master files.
The Client warrants that they possess the necessary rights and consents from all individuals appearing in or recorded within the submitted media, and that such media does not infringe upon third-party rights or applicable laws.
4. Production Turnaround & Revision Rounds
Standard turnaround for an episode (up to 60 minutes of raw dialogue) is typically 3 to 5 business days from confirmed receipt of all media assets. Each standard project includes one complimentary revision round to adjust pacing, subtitle phrasing, or graphic placements, provided revision requests are submitted within 14 calendar days of draft delivery.
5. Limitation of Liability
The Studio exercises high professional care using calibrated audio equipment and video editing software. However, the Studio is not responsible for intrinsic capture defects beyond repairable limits (such as severely clipped audio recordings, heavily out-of-focus camera footage, or missing media). The Studio's total aggregate liability arising out of any engagement shall not exceed the fees paid by the Client for the specific project in dispute.
6. Dispute Resolution & Governing Law
The parties agree to resolve any disagreements in good faith through direct communication via [email protected]. These Terms are governed by Norwegian law, without prejudice to mandatory statutory consumer protections provided under the electronic commerce regulations of the Client's country of residence.
